夫妻财产中不动产物权关系冲突规范适用研究

摘　　要：我国立法者在2010年通过的《涉外民事关系法律适用法》立法过程中,尚未采用学者的建议和先前的立法经验,回避了夫妻财产中不动产的冲突规范适用问题。这直接导致了司法实践中法院在处理涉外夫妻不动产纠纷时,冲突规范的选用出现了明显的分歧和混乱。而基于夫妻财产关系的特殊性,对于此类法律关系,《涉外民事关系法律适用法》第二十四条优先于不动产物权规则优先适用是应有之义。未来我国夫妻财产制的完善,应当引入"同一制",并在法律实践中不断改进该制度。Without adopting scholar’s advice and previous legislative experience,legislators avoided the issue about the application of conflict law to real estate of marital property during the legislative process of The Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China,which was passed in 2010.This has directly given rise to the divergence and confusion of choosing appropriate conflict rules when judges are dealing with the foreign real estate of marital property conflicts in practice.Given the characteristics of marital property relation,Article 24 of the Law gains prioritized application over the real property rule and unitary system is supposed to be imported during the future perfection of marital property system and should be ameliorated in legal practice.
