美军战俘工作的法治化考察及启示

摘　　要：较为健全的战俘工作法规体系是美军开展战俘工作的基本依据与制度保障。美军依法进行被俘教育训练、依法实施战俘管理等做法,对于增强官兵战场适应能力和凝聚军心士气有积极作用。当然,美军战俘工作实践中仍然存在政出多门、衔接配套不够、修订滞后指导实际不力、执法人员素质低下削弱法规效力等问题。当前,应当充分汲取和借鉴美军在依法开展战俘工作方面的经验教训,以促进我军俘虏工作树立法治化理念,服务瓦解敌军目标的实现。A sound system of laws and regulations is the basic institutional guarantee of POW work in US military.The US army′s practice of providing education and training for the captured,sensible management of detainees,all in accordance with the law,has a positive effect on enhancing the soldiers′ability to adapt to the battlefield and building the morale of the army.There are some prominent problems in the practice of POW work of US military,such as insufficient coordination of government affairs,inadequate guidance in actual revision,low quality of law enforcement personnel and weak effectiveness of law enforcement.We should draw on from US military′s experience and lessons in carrying out POW work so as to promote our army′s captive work with the concept of rule by law,and to serve the goal of dismantling enemies.
