摘　　要：如何合法使用武力是海军非战争军事行动实践中必须面对的一个重大现实课题。依据相关国际法文献及我国国防政策,人民海军遂行非战争军事行动中武力使用应当遵循慑防为主慎重打击、程度适当、灵活运用等原则,并充分考虑武力使用的条件、武器选择及实施程序等规则要求。Resorting to force on a legal basis is a serious issue that the navy must face in the practice of military operation other than war.According to the relevant international law and China′s national defense policy,the use of force in the PLA navy′s military operation other than war should follow the principles of deterrence and prevention as priority,carry prudent strike in an appropriate extent with legal justification.The overall conditions for weapon selection,implementation procedures and other rules and requirements should all be taken into consideration.
