摘 要:通过对中华人民共和国成立70年来产假制度文件的回顾梳理可以发现,我国的产假时长由最初的56天增加到98天,全面两孩政策实施后各省产假时长延长至128~365天。产假期间的薪资待遇渐近明确,保险机制逐步引入;出发点由最初的女性权益保障转变为妇女、儿童的权益保障,从保障落实国家计划生育政策转变为保障个人权利,涉及地点从家庭领域拓展到工作场所;随着陪产假制度的落实,社会性别公平理念逐步融入。虽然中国产假制度随着生育政策调整而不断完善,但依然存在产假时长地区差异过大、部分地区和企业产假制度落实难的问题,需要进一步调整和解决。The study analyzes the adjustment of maternity leave in China in the past 70 years by reviewing the documents since 1949.The length of maternity leave increases from the initial 56 days to 98 days,and then reaches 128~365 days.The paid maternity leave is gradually improved and the insurance mechanism is introduced.The transition includes:(1)Change of intention from protecting rights and interests of women only to protecting that of women and children.(2)Change of intention from implementing of the national family planning policy to protecting right of individual.(3)Change of place from home only to workplaces and home.(4)Gender equity is gradually integrated with the implementation of paternity leave policy.Although the maternity leave policy has been improving,challenge still exist such as great differences at provincial level,difficulties in policy implementing in some regions and enterprises,which need to be solved.
