近郊村的“反租倒包”:三权分置与三重合约

摘　　要："反租倒包"是中国农地流转的重要形式之一。东部沿海发达地区近郊村农地产权格局的历史变迁显示,"两权分离"的农地制度安排在平衡公平与效率的过程中,自发地走向内涵"三权分置"的反租倒包模式,坚持和强化集体土地所有权的统筹能力;发展和凸显集体成员承包权的财产属性;渐进式地推动农地经营权的市场化。农地流转的三大主体由此确立三重合约:其一,集体经济组织与集体成员之间形成具有弹性的身份合约;其二,集体经济组织与农地经营者之间形成纯粹的市场合约;其三,集体成员和农地经营者之间形成隐性的关系合约。这一具有多重合约的农地产权同时生成集体组织的治理绩效、农地利用的经济绩效和集体成员的民主绩效。"Leaseback and Subcontract"is one of the important forms of agricultural land circulation in China.The historical changes in the pattern of farmland property rights in the suburban villages in the eastern coastal developed areasee Major Contracts show that"the separation of two rights"farmland system arrangement spontaneously moves towards the leaseback and subcontract model of"the separation of three rights"in the process of balancing equity and efficiency:adhering to and strengthening the collective planning of collective land ownership;developing and highlighting the property attributes of the contracting rights of collective members;and gradually promoting the marketization of farmland management rights.The three main bodies of agricultural land circulation have thus established a triple contract:firstly,a flexible identity contract is formed between the collective economic organization and the collective member;secondly,a pure market contract is formed between the collective economic organization and the farmland operator;thirdly,a hidden relationship contract is formed between the collective member and the farmland operator.This multi-contracted agricultural land property right simultaneously generates the governance performance of collective organizations,the economic performance of agricultural land use,and the democratic performance of collective members.
