摘　　要：《长江保护法》作为综合性流域法的立法定位,以及协调长江流域内多元利益的现实需要,决定了健全长江流域管理体制是《长江保护法》的立法重点。基于政策文件与水事法律的规定,结合政府机构改革、环境监管体制改革、流域管理机构改革的成果,适当借鉴国外流域管理体制运作的成功经验,分析了健全流域管理体制的基本原则,指出《长江保护法》需要明确规定流域管理体制的基本模式,健全长江流域行政管理部门的职能配置,改革现有流域管理机构,以逐步实现流域综合管理。The improvement of management system in the Yangtze River basin is the legislation emphasis of the"Yangtze River protection law"in accordance with its legislation orientation of comprehensive basin-level law as well as the practical need of coordinating multilateral interests in the Yangtze River basin.According to the provision of central policy documents and water-related laws,combined with the reform achievements of government agencies,environmental supervision system and basin management agencies,learning from the performance experiences of foreign basin management system appropriately,the main principles on the improvement of basin management system was firstly suggested.The basic pattern of basin management system in"Yangtze River protection law",the compartmentalized function of government and its functional departments and the reform of basin management agencies should be stipulated clearly to gradually realize basin comprehensive management.
