摘 要:目的分析治疗溃疡性结肠炎(UC)的中药发明专利技术信息,为后续专利研发和布局提供参考。方法通过国家知识产权局专利检索及分析系统和欧洲专利局数据库检索治疗UC的中药发明专利文献,通过技术生命周期预测发展趋势,分析地域分布,从重点专利权人、复方配伍、中药提取物3个技术信息角度进行分析。结果治疗UC的中药发明专利共计324件,申请热度逐年提高,现阶段处于技术成熟期,申请区域集中在非核心技术区域的山东、河南和安徽;重点专利权人有河南中医药大学和邓泽潭,技术特点为基于中医理论的复方专利研发;复方专利模式较成熟,数据挖掘结果总结了适用于不同分期及各中医证型的药组;中药提取物专利发展较为薄弱,安全性和有效性有待提高。结论应加强核心技术区域科研人员的成果转换意识;治疗UC中药研发主体应保持在中医理论指导下,借鉴数据挖掘的中药组合规律,构建具有中医药特色的中药复方专利保护体系;提取物专利申请宜立足于单体和制备方法。Objective To analyze the technical information of TCM patents for treating ulcerative colitis(UC);To provide references for subsequent patent research and development and layout.Methods Patent literature about UC from Patent Searching and Analyzing System of the State Intellectual Property Office and the European Patent Office was retrieved.Technology life cycle was used to predict development trends and analyze geographic distribution.The three technical information angles of key patentees,collocation formulas and TCM extracts were analyzed.Results There were 324 TCM patents for treatment of UC.The popularity of applications was increasing year by year,and the technology was at a mature stage.The application areas were concentrated in non-core technology areas of Shandong,Henan and Anhui;The key patentees were Henan University of Chinese Medicine and DENG Zetan,whose technical characteristics were compound patent R&D based on TCM theories;The compound patent model was relatively mature,and the data mining results summarized the medicinal groups applicable to different stages and various types of TCM syndromes;The patent development of TCM extracts was relatively weak,and the safety and effectiveness needed to be improved.Conclusion Researchers in core technology areas should enhance their awareness to transform scientific findings to practice.Besides,researchers developing TCM for UC treatment should abide by TCM theories while understanding the patterns of compound formulas based on data mining technology as to build up a compound patent protection system with TCM characteristics;applications for patents of TCM extracts should be based on the monomer and preparation method.
