战“疫”背景下基层维稳的法治困境与强化路径

摘　　要：新冠肺炎疫情的暴发既是对国家治理能力和治理体系的一次大考,也是对基层维稳工作的一次检验,战"疫"背景下基层维稳面临着全局稳定与局部隐患并存,思想上高度重视与认识不准确、不到位并存,手段上严厉有余与规范不足并存。基层维稳法治化也面临着专门法律制度缺失,基层维稳无法可依;部分领导干部法律责任弱化,形式主义、官僚主义盛行;基层群众法治意识淡薄,守法上存在障碍。因此,建构法治思想宣传机制、法治思维养成机制、法治方式监督机制、法治维稳推进机制、法治信息化交流机制、违法行为严惩机制成为战"疫"背景下基层维稳的法治化路径选择。The outbreak of COVID-19 is not only a rigorous test for the governance capacity and system in our country,but also a big challenge for the stability maintenance at grass-roots level.Against the background of fighting against the pandemic,the stability maintenance work at grass-roots level are facing many problems:local hidden dangers coexisting with overall social stability;giving priority to stability maintenance coexisting with inaccurate and insufficient knowledge;measures taken to maintain stabilization being strict but not standardized enough.There are also deficiencies in grass-roots stability maintenance based on the rule of law.For example,due to the lack of a specialized legal system,grass-roots stability maintenance has no law to abide by;some leading cadres’weakened legal responsibilities result in prevailing formalism and bureaucracy;grass-roots people lack the consciousness of rule of law,which forms obstacles for them to abide by law.Therefore,against the background of"pandemic"fight,to construct a series of mechanisms related to propaganda for rule-of-law ideas,the development of the rule-of-law thinking,the supervision for the rule-of law ways,promoting the stability maintenance based on the rule of law,the informatization exchanges based on the rule of law,and the severe punishment for illegal acts has become the approach to maintain grass-roots stability based on the rule of law.
