摘 要:随着党的十九大提出乡村振兴战略,并将治理有效纳入总体要求,乡村治理成为国内学者与专家关注的热点。但现有的研究更加集中于"发展地"类的乡村,而"保护地"类乡村的研究较少。文章基于产权理论视角,以西湖风景区内9个景中村为例,分析景中村治理过程中的困境,并试着提出优化路径。结果显示:景中村治理困境在于风景区保护法律制定过程中对村民财产权的忽视、发展权的限制及收益权的削减。为此,提出风景区保护制度要正视景中村村民财产所有权、重视发展权诉求及拓宽收益权渠道。西湖景中村治理困境与经验也为我国其他风景区乡村治理提供借鉴。With the 19th National Congress of the Communist Party of China,the rural revitalization strategy was put forward governance was effectively incorporated into the overall requirements,and rural governance has become the focus of domestic scholars and experts.However,the existing research is more focused on the"development"type of villages,while the"protected"type of villages is less.Based on the property right theory,this paper takes 9 scenic area villages(SAV)in the west lake scenic area as an example to analyze the plight of SAV in the process of governance and try to put forward an optimized path.The result shows that the governance dilemma of SAV lies in the neglect of the villagers'property right,the restriction of the right to development and the absence of the right to profit in the process of making the scenic spot protection law.Therefore,this paper proposes that the scenic spot protection institution should face up to the property ownership of SAV villagers,attach importance to the demand of development right and broaden the channels of revenue right.The predicament and experience of village governance in West Lake also provide reference for other scenic areas in China.
