摘　　要：在标准化法二元结构统摄的多层次体系中,标准化法结构由制定法《标准化法》和共同法“标准化导则”同构而成,经由《标准化法》第2条1款的接口,制定法与共同法分别呈现出接受与包容、共同法引领和共同法沉隐3种形态。商品条码和《商品条码管理办法》作为例证,为我们观察这种同构关系状态的生成,提供了窗口。当今,标准化法已形成以《标准化法》为核心,由特别法、附属法和地方法共同构成的体系,但由于《标准化法实施条例》性质不明,给该体系带来实施中的困惑。为此,应进一步发挥共同法对不同层次不同类别标准化活动共同与统一的适用,克服和约束标准化法体系内可能发生的冲突与矛盾,与《标准化法》一道共同推动和保障中国标准化事业的繁荣发展。The multi-level system governed by dual structure of the Standardization Law of China,has been shaped by enacted law and the common law of"standardization guideline".According to the Article 2(1)of the Standardization Law,the enacted law and common law act in three forms respectively:mutual acceptance and inclusion,the common law plays a leading role or does not perform a function.For example,the generation of this isomorphic relationship can be observed by analyzing commodity bar code and The Regulation on Commodity Bar Code.Nowadays,the Standardization Law has formed a system with itself as the core,and special law,ancillary law and local law as main contents.However,due to the unclear nature of the Regulations for the Implementation of the Standardization Law,the confusion in the implementation of the system still exists.Thus,the common law shall be applied into standardization activities of different levels and categories,so as to overcome and constrain possible conflicts and contradictions within the standardization legal system,and jointly promote and guarantee the prosperity and development of standardization enterprise in China together with the Standardization Law.
