摘　　要："法制先行",是浦东开发开放的基本原则,在与社会主义市场经济相适应的法律尚未形成时,坚持这项原则就是施行法治。浦东开发开放的任务和特点,决定了法治出自浦东开发开放内生的需要。遵循"法制先行"原则,可以构建政府和社会合作的治理结构,可以通过制度创新克服法律缺失的困难,保障开发开放得以顺利进行。上海"讲规则"的地域文化为实施"法制先行"原则提供了相对较好的条件和环境,法治也同时改良了这种地域文化。"Legal system first"is the basic principle of the development and opening-up of Pudong.When the law suitable for the socialist market economy in Shanghai is yet to be formed,adhering to this principle is to implement the rule of law.The tasks and characteristics of the development and opening-up of Pudong determine that the rule of law comes from the endogenous needs of the development and opening-up of Pudong the fact.Following the principle of"legal system first",it is possible to construct a governance structure of the cooperation between the government and the society,and to overcome the difficulties of legal deficiencies through institutional innovation,and to ensure the smooth development and opening-up.The regional culture of"adhering to rules"in Shanghai provides relatively favorable conditions and environment for the implementation of the principle of"legal system first",and the rule of law has,in turn,improved this regional culture.
