丽江永宁摩梭人走婚习惯法的存续与递嬗——基于法人类学视角的探究

摘　　要：走婚习惯法有效地维系了摩梭两性关系的和谐稳定,对于母系文化的延续发挥着不可替代的作用。摩梭母系文化是走婚习惯法传承至今的深层次力量,走婚习惯法所蕴含的法理基础是其流衍至今的运作机理。在经济结构转型发展和旅游业冲击的背景下,走婚习惯法面临着走婚价值观转变、禁忌律条松懈等层层挑战。以法人类学视角检视走婚习惯法的“变”与“不变”,将在新的维度上推进摩梭文化的保护与传承。The customary law of walking marriage effectively maintains the harmony and stability of the sexual relations in Mosuo people and plays an irreplaceable role in the continuation of matriarchal culture.The matriarchal culture of Mosuo is the deep-rooted force for the inheritance of the walking marriage customary law,and the legal basis contained in the walking marriage customary law is the operating mechanism of its evolution to this day.Under the background of structural transformation and tourism impact,the customary law of walking marriage is faced with challenges such as the changes of values of walking marriage and the relaxation of taboos and regulations.This paper examines the“changes”and“invariabilities”of the customary law of walking marriage from the perspective of law anthropology,which will promote the research on the preservation and inheritance of Mosuo culture with the new dimension.
