阻碍警察执行职务行为实证分析及应对策略

摘　　要：阻碍警察执行职务行为不仅对公安民警人身安全和个人声誉造成侵害,也极大地损害了国家法律尊严和公安机关执法权威。对近五年来妨害公务罪的司法裁判进行分析,发现对因阻碍警察执行职务构成妨害公务罪要求存在人身或财物损害结果的判决比例下降,适用缓刑的比例较高。阻碍警察执行职务行为中行为人使用徒手、聚众阻碍情况较多,行为人处于醉酒状态较多,基层派出所的民警遭遇阻碍执行职务行为较多。公安机关应在法治宣传、现场处置、证据固定、民警培训、警务保障等方面采取相应的应对措施。Behavior obstructing police’s execution of duties not only infringes upon police’s personal security and personal reputation,but also greatly damages the dignity of law and the law enforcement authority of the public security organs.An analysis of the judgments made in the past five years as to the crime of interference with public administration has found that,the proportion of judgments requesting personal or property damage to constitute a crime of interference with public administration due to the behavior obstructing police’s execution of duties declines,while the proportion of probation is higher.Among the behaviors obstructing police’s execution of duties,the circumstances that the perpetrators obstructed by freehands or gatherings are more,the perpetrators were in a state of drunkenness are more,and police from basic police station have encountered more behaviors obstructing execution of duties.Public security organs should take corresponding countermeasures in the areas of law publicity,on-site disposal,evidence fixing,police training and police affairs safeguard.
