本土孝文化的当代法理价值与启示

摘　　要：孝文化是古代社会调整代际亲属关系的重要依据,主要经历了萌芽、儒家化、法律化三个发展阶段。当前我国社会结构和本土孝文化所赖以生存的社会环境发生了较大变化,导致孝文化的历史局限性进一步凸显。在全面依法治国的时代背景下,应发掘本土孝文化所具有的当代法理价值并引入立法,以隐形契约关系促使家庭单元稳定,以家庭伦理引导社会伦理发展,以孝文化的弘扬促进德治与法治有机结合,将精神赡养与物质赡养相结合,以建构具有本土性文化特征的中国特色老年法体系;同时,完善文化、立法、司法、制度等方面的保障,树立正确的孝文化理念,实现硬法和软法有机衔接,发挥调解在代际亲属问题处理中的作用,实现个体养老到社会养老的转型过渡,以应对社会转型中的代际矛盾。Filial piety culture is a vital basis for the adjustment of intergenerational kinship in ancient society.It mainly experienced three stages of development:infancy,Confucianism and legislation.The current social structure of our country and the social environment on which the traditional filial piety culture relies have undergone major changes,leading to the historical limitations of the filial piety culture becoming more prominent.In the era of comprehensively governing the country according to law,the contemporary jurisprudential value of the traditional filial piety culture should be explored and legislation should be introduced to promote the stability of family units with invisible contractual relations,the development of social ethics with family ethics,and the promotion of rule of virtue with the promotion of filial piety culture.The rule of law is organically combined,combining spiritual support with material support to build an elderly law system with Chinese characteristics that has traditional cultural characteristics;At the same time,we should improve the protection of culture,legislation,judicature and institution,establish the accurate concept of filial piety culture,realize the organic connection between hard law and soft law,play the role of mediation in dealing with intergenerational kinship issues,realize the transition from individual pension to social pension,and deal with the intergenerational contradictions in social transformation.
