司法协助视角下律师《调查令》查询个人信用信息问题探析

摘　　要：国际上主要国家高度重视个人信息保护工作。近年来,以公检法为代表的国家机关请求基层人民银行分支机构协助查询个人信用信息数量急剧增长,同时国内部分省市先后制订了律师《调查令》试行办法。在实践中,律师《调查令》制度缺乏立法支持,律师持令要求司法协助行为的合法性颇具争议,且与中国人民银行征信中心相关查询规程存在冲突,导致了基层人民银行分支机构对于是否受理律师持令调查做法不一。因此,要尽快依法确立律师调查令制度,司法机关应严格依法调查取证,中国人民银行要修订完善征信对外查询服务规程,依法履行司法协助义务,切实保障信息主体合法权益。International major countries attach great importance to the protection of personal information.In recent years,the number of state organs represented by the public security organs and the People's Bank of China asking the branches of the People's Bank of China to assist in the inquiry of personal credit information has increased sharply.At the same time,some provinces and cities in China have formulated the trial measures of lawyers'investigation order.In practice,the lawyer's"investigation order"system lacks legislative support,the legality of lawyers'demand for judicial assistance is controversial,and confl icts with the relevant inquiry rules of the credit reference center of the People's Bank of China,which leads to different practices of grassroots branches of the People's Bank of China on whether or not to accept the lawyer's order for investigation.Therefore,it is necessary to establish the lawyer's investigation order system as soon as possible.The judicial organs should strictly investigate and collect evidence according to law.The People's Bank of China should revise and improve the service regulations for external inquiry of credit investigation,fulfill the obligation of judicial assistance according to law,and effectively protect the legitimate rights and interests of information subjects.
