摘　　要：接甘肃省饲料工业办关于甘肃×饲料生产企业生产的仔猪配合饲料金霉素超标的通报文件后,2018年10月20日经夏河县农业农村局立案调查,通过实地查验库房、核对生产记录、调阅中控数据的方式,印证了超标添加抗生素生产饲料的违法行为。经研究决定对该公司不遵守兽药安全使用规定生产饲料抗生素超标的行为处以30000元罚款。同时就违法行为定性、罚则应用和案件查办盲区进行讨论,提出了注重法律衔接,斟酌法则应用,加强生产监管等措施,以期为提高同类案件办理规范化程度提供参考。On October 20,2018,a notification concerning excessive chlorotetracycline within compound feed for piglets produced by a feed manufacturer was issued by Gansu Feed Industry Office,a case concerning excessive addition of antibiotics in feed production was investigated and identified by means of on-site inspection of warehouses,verifying production records and accessing to the central monitoring data by Xiahe Bureau of Agriculture and Rural Affairs.It was decided to impose a fine of ￥30000 yuan on the manufacturer for its non-compliance with the regulations on safe use of veterinary drugs.In addition,identification of illegal acts,application of penalty provisions and blind areas during the investigation were discussed,and some measures were suggested,such as paying attention to the connection of laws,considering the application of laws and strengthening the supervision over production,so as to provide some references to improve the standardization of handling with similar cases.
