论纪检机关权力的监督——兼评《中国共产党纪律检查机关监督执纪工作规则》

摘　　要：《中国共产党纪律检查机关监督执纪工作规则》是当前指导监督执纪工作较为系统而权威的规章制度,具有坚持党的领导优先,凸显纪检监察一体化,重视监督制度构建,引入参与式监督设计等特色。纪检机关权力监督制度的主要成就为从干部准入、登记备案、回避、借调、保密、谈话、安全责任、检查、违纪违法问责、一案双査与终身责任等方面健全了纪检机关内控机制,但也存在自律规则执行缺乏独立性、他律规则制定缺乏操作性、追责条件限定缺乏精准性、举报规则认定缺乏灵活性等不足。若要在党风廉政建设和反腐败工作中将纪检机关权力装进制度笼子,应推广纪委书记异地监督执纪工作制度,细化社会监督和群众监督具体制度,明确纪检机关责任追究适用条件,实施有条件的越级举报制度。"Regulations on the Supervision and Implement of the Discipline Inspection Organs of the Communist Party of China"are systematic and authoritative rules and regulations to guide thesupervisionanddiscipline work.It gives priority to the party's leadership,highlights the integration of discipline inspection and supervision,attaches importance to the construction of supervision system,and introduces participatory supervision design.The main achievements of the power supervision system of discipline inspection organs are to improve the internal control mechanism of discipline inspection organs from such aspects as cadre admittance,registration and filing,withdrawal,secondment,confidentiality,conversation,safety responsibility,inspection,accountability for discipline violation and law violation,double investigation and lifelong responsibility.However,there are also deficiencies such as the lack of independence in the implementation of self-discipline rules,the lack of operability in the formulation of heteronomous rules,the lack of precision in the limitation of accountability,and the lack of flexibility in the determination of reporting rules.If we want to institutionalize the power of discipline inspection organs in the construction of clean and honest party conduct and anti-corruption work,we should promote the system of supervision and enforcement of discipline in different places by the secretary of the commission,refine specific systems for social and public supervision,clarify the applicable conditions for the investigation of the responsibility of the discipline inspection authorities,and implement a system of leapfrog reporting under certain conditions.
