摘 要:在申请承认与执行外国法院判决过程中,申请执行的时效是一个不容忽视的因素。对于申请执行的时效,《海牙判决公约》等国际性公约倾向于规定由被请求国根据国内法来进行规制。在国内立法方面,不同国家由于历史传统、法律文化以及社会发展程度等方面的差异呈现出不同的立法模式和法律规定,集中体现在关于申请执行时效的性质认定、时间长短以及起算点等方面。就我国的法律规定而言,建议通过延长申请执行的时效期间、在双边司法协助条约中明确规定申请执行时效的法律适用等方式改进我国关于申请执行时效的法律制度。When seeking the enforcement of foreign judgment, limitation period is one of the factors that creditors need to consider. At the international level, international treaties, e.g., the Hague Judgment Convention, provide that the procedure for enforcement is governed by the law of the requested State. At the domestic level, many States have different historical traditions, legal culture, and they are in different stages of social development. As a result, different States have diversified legislation modes and legal provisions on limitation period, especially on the characterization of the limitation period, the length and the commencement of the limitation period. Regarding the Chinese laws on limitation period, the legislators are suggested to extend the duration of the limitation period for enforcement. It is also advised that, when China concludes bilateral treaties with foreign countries, a provision that explicitly establishes the law applicable to determine the limitation period should be included.
