论奥运会重要事项及其变更的依据之憾与规则完善——从东京奥运会延期论起

摘　　要：在全球新冠肺炎疫情不断蔓延的情势下,国际奥委会和东京奥组委联合决定2020年东京奥运会延期举办。这一着眼于人类生命健康安全的重要决定具有充分的伦理正当性,但也需进行是否符合《奥林匹克宪章》的合法性考察。通过对法治奥运已成为现代奥运的治理模式的揭示,认为奥运重要事项及其变更应以宪章为据,东京奥运会延期虽然符合由国际奥委会执委会决定的程序规则,却明显违反了宪章关于奥运会举办时间的实体规定。进而结合宪章为适应发展而反复修改的历程,分析了宪章在奥运会重要事项等方面规则仍存在的一些缺憾,强调法治奥运应奉行良法之治,使宪章更全面地覆盖奥运全局和及时回应奥运实践发展,对进一步修改完善《奥林匹克宪章》中奥运会等重要事项及其变更的规则与机制进行了探讨。In consideration of the COVID-19 pandemic around the world,International Olympic Committee(IOC)and Tokyo Organizing Committee of Olympic Games(OCOG)jointly decided to postpone the 2020 Tokyo Olympic Games.Although this human health and safety oriented decision has full ethical legitimacy,whether it is in compliance with the legitimacy of Olympic Charter needs to be studied.The rule of Olympics by law,which is a modern Olympic governance model,reveals that the important matters and relevant changes of Olympics matters shall be based on the charter.From this perspective,the postponement of Tokyo Olympics conforms to the procedure rules determined by IOC Executive Board,while violates the regulations on the time of holding Olympics provided in the charter.Therefore,combined with the history of repeated revisions of the charter for adapting to development,the deficiencies of the charter in regulating rules of important Olympics matters and other aspects are analyzed.The rule of Olympics by law shall follow the benign law so as to enable the charter to cover the Olympics comprehensively and respond to the practice of the Olympics timely.In this paper,the rules and mechanisms for further revising and perfecting the important matters and relevant changes of Olympics in the Olympic Charter are explored.
