摘　　要：司法改革必定在刑事裁判与公众认同的复杂关联中跋涉前进,刑事司法裁判需要公众认同,公众对司法公正往往有更高的期待,这就为公众意见进入司法开辟了理论与制度通道。公众意见是一柄双刃剑,运用得当,则司法与公众两得其利;运用不当,则司法与公众两受其害。面对公众认同危机,司法的积极回应比消极逃避更重要,回应既包含着接受,也包含着引导。现代司法要始终坚持一种外在的眼光、开放的立场来思考个案的公正裁判,即发掘司法的核心精神,尊重公众理性的意见表达,为个案裁判注入道德内涵,让公众感受到司法正义。同时,司法应缩短而不是加大法律与社会生活的距离,司法必须重视公众意见,深入挖掘法治的核心精神,应当重视法理思维,为司法注入一定的道德内核,并实现由接受者到回馈者乃至引导者的角色转变。The ongoing judicial reform must steer a course forward amid the complex relationship between criminal judgments and public recognition.Criminal judicial judgments need public recognition,and the public often have higher expectations for judicial justice,which opens up a theoretical and institutional channel for the public opinion to enter the judicial system.Public opinion is a double-edged sword.If it is used properly,both the judiciary and the public will benefit from it.If it is not used properly,both the judiciary and the public will suffer from it.In the face of a public recognition crisis,positive response from judiciary organs is more important than negative escapism.The so-called response includes both acceptance and guidance.Modern justice should always adhere to a third-eye vision and an open mind when it comes to considering the justice of a case,that is,explore the core spirit of justice,respect the rational expression of public opinions,inject moral connotation into legal cases,and let the public feel the‘justice’of justice.At the same time,the judicature should shorten the distance between law and social life rather than widen it.The judicature must earnestly take heed of public opinions,deeply tap the core spirit of rule of law,stress legal thinking and methodology,inject moral ingredients into the judicature,and realize the transformation of the role of the judiciary from a receiver to a giver and even a guide.
