党内法规配套立规的基本标准探析——基于制度文本与制度实践的双重维度

摘　　要：党内法规配套立规是指具有党内法规制定权限的主体为保证上位党内法规的有效实施,制定旨在细化上位党内法规内容的下位党内法规等一系列立规活动。党内法规配套立规的制度文本分析表明,尽管配套立规已逐渐引起中央层面重视,且几乎各类中央党内法规均含有配套性条款,但要求"应当"配套立规的上位党内法规数量还是较少,并集中于党的建设法规与党的监督保障法规领域。从配套立规的实践探索来看,尽管中央部委和地方党委积极展开配套立规工作,但仍然存在一些较为突出的问题,如重复立规、滞后配套、越位配套甚至选择性配套等。法治是现代国家治国理政的基本方式,为增强上位党内法规的针对性、可操作性与可行性,党内法规配套立规也应遵循法治思维及其要求,坚持合法合规、程序正当、因地制宜、科学规范的基本标准,这些立规标准也对上位党内法规制定主体与配套立规主体提出了具体要求,即保障立规的主体、内容与效力合法合规,保障党员参与监督权利,着重对基础主干法规和重点领域配套立规,满足配套立规技术要求。Setting supporting regulations for inner-Party laws and regulations refers to a series of activities that the subject with the authority to formulate inner-Party laws and regulations,formulates lower-level inner-party laws and regulations to refine the contents of upper-level laws and regulations and ensure the effective implementation of them.The analysis of the institutional text shows that although setting up supporting regulations has gradually attracted the attention of the CPC Central Committee,and almost all kinds of central-level inner-Party laws and regulations contain the supporting clauses,the number of upper-level innerParty laws and regulations that require supporting regulations is still small,which are concentrated in the fields of Party building and supervision guarantee.From the practical exploration of setting supporting regulations,although the ministries and localities actively carry out the work,there are still some prominent problems,such as repeated regulations,lagging behind supporting,offside and even selective supporting.As the rule of law is the basic mode of governance in modern countries,to formulate supporting regulations for inner-Party laws and regulations should follow the legal thinking and its requirements,and adhere to the basic standards of legal compliance,due process,local conditions and scientific norms to enhance the pertinence,operability and practicability of the upper-level inner-Party laws and regulations.These standards also put forward specific requirements for the subject that has the authority to set up upper-level laws and regulations and the supporting regulations,that is,to ensure the legal compliance of the main body,content and effectiveness,and to ensure the Party members’right to participate in supervision,focus on the basic backbone laws and regulations and meet the technical requirements of setting supporting regulations.
