摘 要:此次监察体制改革将监察权置于中心地位,同时监察机关与相关机关的职权关系和界限仍存在着一定的模糊性,难免出现“监察中心主义”以及监察权与相关职权之间的职权交叉和侵犯现象。因此,通过分析我国监察机关与检察机关、公安机关和党的纪律检查机关的职权性质,梳理相关法律法规和文献资料,发现监察机关与检察机关之间存在着相互配合和制约的职权关系,与公安机关存在着相互配合和协作的职权关系,与党的纪律检查机关存在分工和衔接的职权关系。这些职权关系的厘清有利于进一步划清各机关的职权界限,实现各机关在反腐败工作中的集约高效运作。This reform of the supervision system puts the supervision power in the central position.At the same time,there is still some ambiguity in the authority relationship and boundary between the supervision organ and the relevant organs,which inevitably leads to the"supervision centralism"and the overlapping and violation of the authority between the supervision power and the relevant authority.Therefore,by analyzing the functions and powers of the supervision institutions and the procuratorialinstitutions,the public security institions and the party's discipline inspection institution,combing the relevant laws,regulations and literature,it found that there is ainteraction and restriction of relationship between supervisory institutions and procuratorialinstitutions,and a mutual cooperation and collaboration with the public security institutions,and the division of labor and cohesion with the party's discipline inspection institutions.The clarification of these functions and powers is conducive to further delineating the related organs and realizing the intensive and efficient operation of each organ in the anti-corruption work.
