论数罪并罚量刑原则的正当性依据

摘　　要：作为一种量刑原则,数罪并罚的正当性依据主要体现为符合刑事政策、形式公平和实质正义。在我国立法规定和刑罚执行现状下,并科原则符合三项正当性依据的要求。适用吸收原则并罚死刑立即执行与其他刑罚以及并罚有期徒刑与拘役时,也符合三项正当性依据的要求。适用吸收原则并罚死缓与其他刑罚或并罚无期徒刑与其他刑罚,以及适用限制加重原则并罚有期自由刑时均不符合三项正当性依据的要求。因此,应适当扩大并科原则与吸收原则的适用范围将更符合数罪并罚量刑原则的正当性要求。As a principle of sentencing,the justification of combined punishment for several crimes is mainly reflected in its conformity with criminal policy,formal fairness and substantive justice.Under the current situation of our country's legislation and penalty execution,the principle of combining branches meets the requirements of three justifications.When applying the principle of absorption,the combined punishment of death penalty for immediate execution and other punishments,as well as the combined punishment of fixed-term imprisonment and criminal detention,also meet the requirements of the three justifications.The application of absorption principle combined with suspended death and other penalties or combined with life imprisonment and other penalties,as well as the application of limited aggravation principle combined with fixed-term freedom penalty,do not meet the requirements of the three justifications.Therefore,it is more in line with the legitimacy requirements of the principle of combining punishment for several crimes by appropriately expanding the scope of application of the principle of combining punishment and absorption.
