中国深度参与北极治理问题研究:以缔结《预防中北冰洋不管制公海渔业协定》为视角

摘　　要：国际规则的制定是中国参与北极治理的内容之一。《预防中北冰洋不管制公海渔业协定》是冷战后中国参与缔结的首个北极区域性条约,这无疑具有里程碑式的意义。然而,中国参与缔结《预防中北冰洋不管制公海渔业协定》同样反映出了一些问题。一方面,中国参与的意愿和能力与主导缔结条约的国家存有差距;另一方面,中国未能充分运用相关国际制度、机制和组织。中国是制定北极国际规则的建设性参与者,也可以成为深度参与北极治理的先行者。基于此,中国应加强参与意愿、提升参与能力,运用好相关国际制度、机制和组织,从而通过缔结条约深度参与北极治理。International rule-making is part of China’s participation in Arctic governance.Agreement to Prevent Unregulated High Seas Fisheries in the Central Arctic Ocean undoubtedly represents a milestone for China as this is the first Arctic regional treaty that China has signed since the end of the Cold War.However,China’s participation also highlighted some problems.A gap remains between China and other treaty parties in terms of willingness and capability to participate.China also failed to make full use of related institutions,regimes and organizations.China participates constructively in the making of international rules in the Arctic,and could become a pioneer with a deep engagement in Arctic governance.Therefore,China should strengthen and improve its willingness and capability to participate,make full use of related institutions,regimes and organizations,and show deep engagement in Arctic governance by concluding the treaty.
