成本收益理论下建设用地指标行政配置效率分析与法律制度选择

摘　　要：过度的行政管控致使建设用地指标配置效率低下,严重影响区域经济的可持续性发展。在市场经济条件下,建设用地指标配置采取何种方式决定了资源的优化配置。传统行政配置制度以指标公平配置为逻辑起点,导致指标供给结构性失衡。在国土空间规划背景下,建设用地指标配置呈现生态性革新和空间性扩张新趋势。为打破传统建设用地指标的行政法范式,运用成本收益理论对建设用地指标行政配置进行效率分析,指出在建设用地指标行政配置中适度引入市场,建立“行政配置+市场配置”相融合的制度,实现私权回归和摆脱传统行政法范式羁绊,实现建设用地指标配置的帕累托最优。Excessive administrative control leads to low allocation efficiency of construction land index,which seriously affects the sustainable development of regional economic development.Under the condition of market economy,the way of allocation determines the optimal resource allocation.The administrative allocation takes fairness as the logical starting point,leading to the supply-side structural imbalance of the construction land index.With the progress of territorial space planning,the construction land index allocation is ecologically upgrading and spatially expanding.In order to break the administrative law paradigm of traditional construction land index allocation,the paper analyzes the efficiency of the administrative allocation of construction land index by using the cost-benefit theory and puts forward that the government should properly introduce of the market,set up an integration mechanism of administrative allocation and market allocation,innovate the legal system of the allocation of construction land index to get rid of the fetters of the traditional administrative law paradigm,achieving pareto optimality in the allocation of construction land index.
