摘 要:实体正当当事人是主观诉讼当事人适格标准,以“利害关系”为理论支撑;而形式正当当事人则是客观诉讼当事人适格标准,以“诉讼担当”为理论依据。行政诉讼担当制度肇始于民事诉讼领域,属于形式正当当事人范畴,突破了“实质利害关系”标准的束缚,与传统实体正当当事人标准共同构成了行政诉讼当事人适格的二元体系。我国行政诉讼担当的发展,总体上呈现出“制度先行,理论缺位”的基本态势。实体正当当事人概念的扩张无法统帅这一新的制度实践,而理论研究对其又缺乏正面关注,因此有必要从理论上对行政诉讼担当进行系统的思考,进而探索其对制度完善的指导意义。The substantive rightful party is the standard of subjective litigant eligibility,which is supported by the theory of“interest relationship”.The formal rightful party is the objective standard of litigant eligibility,according to the theory of litigation take-on.The administrative litigation system originated in the field of civil litigation and belongs to the category of formal rightful parties.It breaks through the constraint of the standard of“substantial interest”and forms a dual system of suitability of administrative litigants together with the traditional standard of substantive rightful parties.The development of administrative litigation in China generally presents the basic situation of“system first,theory absent”.The expansion of the concept of substantive rightful party cannot cover the practice of this new system,and the theoretical research is less paid attention by the researchers.Therefore,this paper considers that it is necessary to think systematically about the administrative litigation take-on theoretically,and then explore its guiding significance to the system perfection.
