摘　　要：在抗击新冠疫情背景下,生命健康权与自由权、经济权、平等权之间无可避免地会发生冲突。探寻人权价值冲突及其整合之道,直接关系到抗疫的成败得失。在主体上,应当重点整合不同年龄层次患者之间、新冠患者和非新冠患者之间、疫情中心区域和外围区域公民之间的权利冲突;在内容上,应当从优先事项、代价限度、底线平等和修复正义四大路径来整合生命健康权和经济自由权之间的关系。在价值上,从生活、市场、保障、新闻、言论五方面厘清秩序与自由的关系,构建既有稳定抗疫秩序又保持社会活力的良性治理模式。In the fight against the COVID-19 epidemic,conflicts between the right to life & health and the rights to freedom,economy and equality are inevitable.Exploring the value conflicts of human rights as well as the approaches to integrate them is directly related to the success or failure of the battle against the coronavirus.From the perspective of the subject,the conflicts of rights between the young patients and the elder ones,COVID-19 patients and non-COVID-19 ones,citizens in the epidemic center areas and those not should be integrated.In terms of the content,the relationship between the right to life & health and the right to economic freedom from the perspectives of priorities,costs and limitation,baseline equality and restoration of justice should be integrated.On the value side,the relationship between social order and freedom in terms of life,market,security,news and speech should be clarified.This will enables us to build a good governance model which can stabilize the order of epidemic prevention & control order and at the same time maintain social vitality.
