铸牢中华民族共同体意识的法治保障研究

摘　　要：中华民族共同体是现代中国统一多民族国家构建的产物,是一个基于政治、法律、经济和地域等因素的命运共同体。文章认为中华民族多元一体格局是中华民族共同体法治建构的基础,宪法确立的单一制国家结构形式和民族区域自治制度则为铸牢中华民族共同体意识提供法治保障,通过宪政制度和法律规范,将现代国家建构与中华民族共同体建构中的制度选择和法理塑造结合起来,借助民族国家建构的政治法律制度,实现中华民族共同体由历史文化共同体到政治法律共同体转型,最终将为中华民族共同体的法治建设提供保障基础。The Chinese nation community is the product of China's unified multi-ethnic state construction.It is a community of Shared interests and destiny based on political,legal,economic and regional factors.The goal of the rule of law construction of the Chinese nation community is the unity of the Chinese nation state and the pluralism of 56 ethnic autonomy.This paper argues that the theory of the construction of the western nation-state and the theory of the multi-unity of the Chinese nation can serve as theoretical resources for the construction of the rule of law of the Chinese nation community.Community of the Chinese nation's construction path is the pattern of diversity in unity of the Chinese nation under the rule of law as the foundation of logic,through constitutional institution and legal norms,the modern state construction and institutional choice and legal construction of the community construction of the Chinese nation,with the help of national political law system construction,the state sovereignty,national rights,freedom,human rights into the legal system and the national political life,and at the same time,relying on the rule of law construction,strengthen the citizen's right of authorship, national sense by the implementation of the Chinese nation community cultural community to the rule of law, political community community transformation, eventually become China's national unity of ethnic community, We will complete the task of building a modern multi-ethnic state and a community of the Chinese nation.
