日韩专利复审无效制度及其借鉴

摘　　要：专利复审无效制度是专利制度运行中最重要的制度设计之一。虽然日韩的专利复审无效制度与我国相比在程序设计上存在着些许差异,但制度设计目的和主要程序相近,且近年来日韩两国均在复审无效制度方面进行了大量的探索,值得我国进一步研究和借鉴。本文简要介绍了日韩两国的复审无效制度及其近期发展动态,并据此对我国复审无效制度的创新和发展提出意见建议。The patent reexamination and invalidation system is one of the most important part in the operation of the patent system. Although the procedure of patent reexamination and invalidation system in Japan and South Korea are slightly different from that in China, the design purpose and main procedure are similar. Moreover, Japan and South Korea have conducted a lot of exploration in patent reexamination and invalidation system in recent years, which are worthy of further study and reference in China. This paper briefly introduces the patent reexamination and invalidation system in Japan and South Korea and their recent developments, then puts forward some suggestions on the innovation and development of patent reexamination and invalidation system in China.
