智能时代社会公正问题探析

摘　　要：社会公正是个恒久古老的话题,是主体的"人"对客体的"社会"的价值追求。社会公正问题是具体的、历史的,不同的发展阶段会呈现不同的形式。智能时代的到来使传统社会中的公正问题出现了"数据资源不公""数字鸿沟""算法歧视"和"社会排斥"等新的形式。其诱因主要是数字经济发展不均衡、智能技术发展不规范、算法程序有"偏见"以及智能相关制度和政策不完善等。面对智能时代背景下的社会公正问题,可依据"数据正义"实现分配领域的公正来夯实社会公正的基础建设、从弥合"数字鸿沟"到消除"算法歧视"以解决社会公正的技术问题、从制度公正到建设数字政府以完善社会公正的制度设计和从司法公正到"智能法院"的运行以确保社会公正的最后防线等四个方面思考构建社会公正的路径。Social justice is a eternal and ancient topic,which is the value pursuit of the subject’s"human"to the"society"as the object.The issue of social justice is concrete and historical,and takes on different forms in different stages of development.The advent of the intelligent era has led to new forms of justice issues in the traditional society such as"data resources are unfair","digital divide","algorithm discrimination"and"social exclusion".The incentives are mainly due to the uneven development of the digital economy,the irregular development of intelligent technology,the"prejudice"of the algorithm and the imperfect regulations and policies.Facing the problem of social justice under the background of intelligent era,we should consider the path of building social justice from the following four aspects:consolidate the foundation of social justice by realizing the justice in the distribution field according to the"data justice",solve the technical problems of social justice from bridging the"digital divide"to eliminating the"algorithmic discrimination",improve the system design of social justice from institutional justice to building"digital government",and ensure the final defense line of social justice from judicial justice to the operation of"smart court".
