摘　　要：民法典的出台是一个关键的历史时刻,从历史经验来看,民法以及民法典经久不衰的原因大致有三:(私法)自治特性,其规则的形成采用自下而上机制;永不停歇的智慧积累,兼具稳定力和进化力;道德与法律在法典中水乳交融。民法典推出之后,中国民法学人应有意识地推动法律共同体与法律人共同体相互耦合,顺畅运作,沟通法治与教化,使法治中国早日臻于“人法合一”的理想境界;同时,又应沿“一带一路”秉持“共商共建共享”原则,以民商法为制度先锋促使各民族国家相互加深理解,催生新共同法,力争在交易法领域形成一个规范认知具高度共识的意义共同体。在打造中国特色民法教义学体系以及新共同法的伟大进程中,遵循法学实证主义道路的中国民法学人共同体将担当重任。The enactment of China's Civil Code is a crucial historical moment.Historically,there are three fundamental elements contributing to the effectiveness and fairness of civil law and the Civil Code:(1)the autonomy of private law and its underlying mechanism(i.e.the adoption of bottom-up regulation),(2)the accumulation of knowledge,which leads to stability and progressiveness of the civil law and Civil Code,and(3)the incorporation of both morality and legislation.After the enactment of China's Civil Code,it is vital to promote the mutual bonding between the legal system and legal practitioners.This will require smooth operation and effective communication between the two parties in regards to the rule of law and education.With such efforts,Chinese legislation system can be optimized and potentially reach the ideal state of“the unity of citizen and law”.Internationally,it requires the commitment to the principle of“extensive consultation,joint contribution and shared benefits”,alignment with the Belt and Road Initiative and the use of civil and commercial law to promote mutual understanding among nations.In short,these will ultimately lead to the formation of a new commonly shared law in the field of transaction law.Following the jurisprudential positivism road,researchers in the field of China's civil law share the responsibility in the process of building a system characterized by legal dogmatic with Chinese characteristics and a new commonly shared law.
