量刑建议精准化的实践解读与理性思考

摘　　要：量刑建议制度是20世纪末我国地方检察改革中产生的一项公诉制度,其在历史演变进程中形成了“概括刑”“幅度刑”与“确定刑”三种模式。在认罪认罚从宽制度实施的背景下,检察系统推行的量刑建议精准化改革引起法律界尤其是法院系统的争议。量刑建议精准化属于公诉改革的范畴,在我国刑事司法体系中兼具理论及制度正当性。我国地方检察机关正在开展的这项改革虽取得一定成效,却也存在一些规范性问题。推进量刑建议精准化可以通过制定统一的量刑建议指南、完善量刑建议运行机制予以规范,并依靠落实法律援助、加强对量刑建议的动态监督等保障措施来维护程序的正当性。The sentencing recommendation system is a public prosecution system in the local procuratorial reform in China at the end of the 20 th century. With the refinement of the right of prosecution, sentencing recommendations have evolved from "summary sentencing recommendations" to a mode in which "sentence recommendations" and "determined sentencing recommendations" coexist. Against the background of the reform of confession and punishment, procuratorial organs have adopted the reform of sentencing recommendations to improve the accuracy of sentencing, which has led to legal disputes. The precision of sentencing suggestions is a reform of the operation mode of the right of public prosecution, which has theoretical and institutional legitimacy in the context of Chinas criminal justice. At present, this reform has received certain results. There are also a series of normative problems. To promote the reform of the sentencing recommendation system, the traditional prosecution concept should be reformed,establishing the litigation structure of equal negotiation between prosecution and defense,the prosecutor should objectively and comprehensively review the circumstances of sentencing, ensure that the person being prosecuted received substantial legal assistance, and improve a mechanism to change and monitor the sentencing proposal, so as to construct a reasonable path for the precision of sentencing suggestions in China.
