摘 要:2017年6月,《行政诉讼法》第25条第4款的修改正式确立了行政公益诉讼制度,其中诉前程序发挥了重大的作用,是有效结案的主要形式。然而由于立法的粗疏和实践情况的复杂,检察机关在行使检察建议权的时候不可避免地会遇见大量需要自由裁量的情形。合理的界定行政主体的监督管理职责与不作为,检察建议的方式、内容与对象,有利于减少诉前程序中检察建议权行使的随意性和不规范性,也有利于更好的实现诉前程序的目标。In June 2017,the amendment of Article 25,paragraph 4,of the Administrative Procedure Law officially established the administrative public interest litigation system,in which the pre-litigation procedure plays an important role and is the main form of effective closure.However,due to the carelessness of legislation and the complexity of practice,procuratorial organs inevitably encounter a large number of situations requiring discretion when exercising the procuratorial recommendation power.Reasonable definition of administrative subject's supervision and management responsibilities and omissions,the ways,contents and objects of procuratorial suggestions are conducive to reducing the arbitrariness and non-standardization of the exercise of procuratorial suggestion power in pre-litigation procedure,and to better achieve the goal of prelitigation procedure.
