An Exploration of Public Participation Right in Environmental Affairs

摘　　要：我国现行法律确立了公众获取环境信息、参与和监督环境保护的权利。环境事务公众参与权的提出,正是针对参与理念和制度层面的争议问题,从探问理念之争、分析制度困境、寻求实现路径三个视角,对公众参与的核心问题——公众界定、参与范围及与相关权利关系所开展的层层深入的研究。主要包括:明确公众内涵所指的是公民、法人和其他组织;以预防、发现和解决环境问题为中心,合理界定环境事务参与范围;在宪法和环境基本法中确立实体性环境权,以环境信息知情权为前提,以环境救济权为保障,有效构筑环境事务公众参与权与相关权利相生相辅的程序性环境权网络,真正确立环境事务公众参与权。China’s current laws have established the public’s rights to obtain environmental information,to participate in and supervise environmental protection.The proposal of the public participation right in environ⁃mental affairs is precisely aimed at the controversial issues at the level of the idea of participation and at the lev⁃el of system.From the three perspectives of probing into the idea dilemma,analyzing the system response,and exploring the realizing approach,the core issues of public participation,i.e.public definition,participation scope,and the relation to relevant right,have been deeply studied in this article.This study mainly argues that:the public should refer to citizens,legal persons,and other organizations;the scope of environmental affairs should be defined by centering on prevention,detection,and solution of environmental problems;the substan⁃tive environmental rights should be established in the Constitution and the environmental basic laws,and a net⁃work of procedural environmental rights with the mutual complementation between public participation right in environmental affairs and related rights is effectively constructed based on the premise of the right to know envi⁃ronmental information and the right to environmental relief,so as to truly establish public participation right in environmental affairs.
