摘　　要：老龄化进程的加快使得建立健全老年人法律援助扩大机制成为完善老年人保障机制的一项重要内容。世界法律援助制度的发展规律为老年人法律援助的发展提供了指引方向,弱势群体特殊保护理论和积极老龄化理论构成了老年人法律援助机制的坚实基础。为完善老年人法律援助机制,各地纷纷畅通援助渠道,扩大援助案件范围,降低援助门槛,丰富援助服务形式与内容,探索专项法律援助服务,发展多元化法律援助格局。虽取得一定成就,却存在“同案不同援”、专项援助项目开发力度不足、援助理念僵化与多元化援助格局有限等问题。未来我国应构建以法益价值衡量为基础的缓步扩大机制,深入发展老年人专项法律援助项目,探索新型法律援助服务形式,完善老年人法律援助多元化格局。The acceleration of the aging society makes it an important issue to improve the legal aid mechanism for the elderly.The development of the legal aid system worldwide provides a basic track for the direction of the legal assistance for the elderly,and the theory of special protection for vulnerable groups and the theory of active aging form a solid foundation for the legal aid mechanism for the elderly.To expand the legal aid for the elderly,many regions have unblocked aid channels,expanded the scope of aid cases,lowered the threshold for legal aid,enriched the form and content of aid services,explored special legal aid services,and developed a diversified legal aid structure.Despite these efforts,there are many problems to be resolved,such as“different aids for similar cases”,insufficient development of special legal aid projects,outdated concepts of legal aid and lack of diversification.In the future,it is necessary to expand legal aid step by step based on the weighing of legal values,develop special legal aid projects,explore new types of legal services,and the diversify the patterns of legal aid for the elderly.
