摘 要:政教分离是美国的宪政原则之一,被认为是美国献给世界文明最伟大的一份礼物,在保障美国式自由和民主方面发挥了重大作用。但不管是从立法过程、文本内涵、司法实践还是社会现实方面来看,政教分离都不可能真正得到实现;相反,因为宗教对美国社会极强的渗透力,宗教与政治之间的关系密不可分。在美国,政教分离有其存在的必然性,但同时,又有其不可分离的现实基础。政教分离是一个悖论。在高科技飞速发展的今天,美国政教分离的将来命运仍将是不确定的。The separation of state and church is one of the constitutional principles in the United States of America.It is considered as the greatest gift of the United States to world civilization and plays an important role in safeguarding American-style freedom and democracy.However,the separation cannot be achieved in all the following aspects:the legislative process,the constitutional text,the judicial practice and the public life.Instead,religion exerts a great impact to American society and relates closely to the politics.Therefore,the separation of state and church is a paradox in US because it is inevitable but at the same time inseparable of them.Today,with the rapid development of high technology,the future fate of the separation of state and church in the United States will remain uncertain.
