摘 要:劳动关系的建立是我国劳动法律适用的前提。劳动关系认定不明,将导致跨境派遣外国人在我国就业时无法得到劳动法律制度的保障。基于对20份裁判文书的分析,目前实践中法院对不同涉外劳动争议中的劳动关系,存在不同的认定标准。在劳动法层面,劳动主体资格的确定、从属性理论的运用,是劳动关系建立的关键要素。建立规范的劳动关系认定标准,促进外国人劳动争议解决,针对不同的跨境派遣方式,既要调整外国人就业许可的刚性限制,也要提出外国人适用劳动法保护的弹性标准。The establishment of labor relations is the premise of the application of labor law in China.The unclear identification of labor relations will lead to the non-guarantee of the labor law system when sending foreigners to work in China.Based on the analysis of 20 referee documents,the court has different standards for the determination of labor relations in different foreign-related labor disputes.In labor law,the determination of the qualification of labor subject and the application of subordinate theory are the key factors in the establishment of labor relations.The establishment of standardized standards for the recognition of Labor relations,the promotion of the settlement of labor disputes among foreigners,and the adjustment of rigid restrictions on employment permits for foreigners in the light of different modes of cross-border dispatch,the flexible standards for the application of labor law to the protection of foreigners should also be put forward.
