摘　　要：我国是一个农业大国,城市化转型升级不得不面对失地农民的基本生活保障、就业、医疗、养老等社会保障问题。目前各地虽有针对失地农民社会保障的规范性文件陆续出台,但缺乏完整统一的失地农民社会保障法律体系,失地农民对征地补偿的参与权无法得到充分保障,征地补偿形式单一,社会保障化补偿机制缺位,失地农民社会保险转接机制不健全。解决失地农民社会保障问题,必须建立全面完整的失地农民社会保障法律体系,完善失地农民参加社会保险的机制,促进失地农民市民化。China is a big agricultural country.The transformation and upgrading of urbanization have to face the social security issues of landless peasants such as basic living security,employment,medical care,and pension.At present,although there are normative documents for social security of landless peasants in various regions,they lack a complete and unified legal system for social security of landless peasants.The right of landless peasants to participate in land acquisition compensation cannot be fully guaranteed.The mechanism is absent,and the social insurance transfer mechanism for landless peasants is not perfect.To solve the social security problems of landless peasants,we must establish a comprehensive and complete legal system for social security of landless peasants,improve the mechanism for landless peasants to participate in social security,and promote the citizenization of landless peasants.
