摘  要:思想与表达二分法原则最早起源于18世纪下半叶的德国,是著作权法中的一项基本原则,在数百年的审判实践中,经常性地被引用和遵守。随着中国影视行业的蓬勃发展,影视作品中的抄袭、剽窃现象频发,尤其这两年“扒剧风”尤甚。但由于我国《著作权法》并未规定该原则,导致法官在司法实践中对于该类案件的审理缺少体系化的标准,并出现了审判中对于思想与表达的分界点划分模糊等一系列问题。The dichotomy principle of thought and expression originated from Germany in the second half of the 18th century.It is a basic principle in copyright law and has been frequently cited and observed in hundreds of years of trial practice.With the booming development of China's film and television industry,plagiarism and plagiarism in film and television works are frequent,especially in the past two years,the style of"Pickering Drama"is particularly serious.However,this principle is not stipulated in the Copyright Law of China,which leads to a series of problems such as the lack of systematic standards for judges to judge such cases in judicial practice,and the ambiguous demarcation between thoughts and expressions in the trial.
