摘　　要：区块链作为一种新兴的技术,一出现就受到社会各界的广泛关注,近年来相关专利申请日渐增多。区块链技术以比特币等数字加密货币为代表,具有去中心化、匿名性、防篡改等技术优势。一方面,由于区块链技术先天的优势,国家大力倡导发展区块链相关技术,但另一方面,比特币等数字加密货币涉嫌违反我国的现行法律,扰乱金融秩序,危害人民币的法币地位。因此,在面对区块链相关专利申请时,如何对该申请进行《专利法》第5条的审查成为一个难题。本文首先对区块链、数字货币进行简单的介绍,然后,根据不同的情况给出对相关申请进行《专利法》第5条审查的方法。As a new technology,blockchain has attracted wide attention from society.In recent years,there are more and more blockchain related patent applications.Blockchain technology,represented by bitcoin and other digital cryptocurrencies,has the technical advantages of decentralization,anonymity,tamper proof and so on.On the one hand,due to the inherent advantages of blockchain technology,the country vigorously advocates the development of blockchain related technologies.But on the other hand,bitcoin and other digital cryptocurrencies are suspected of violating the laws of the country,disturbing the financial order and endangering the legal status of RMB.Therefore,in the face of blockchain related patent applications,how to examin the application in Article 5 of the Patent Law has become a difficult problem.This paper first gives a brief introduction to blockchain and the digital cryptocurrency,and based on different situation of the application,the examining method is provided.
