多维视角下区域行政协议法治化研究

摘　　要：区域行政协议是区域府际合作治理的一种常态化治理工具,在实践中呈现出行为、规范、制度三个维度。区域行政协议法治化是面向区域府际合作治理实践的理性选择。其中,行为合法是区域行政协议法治化之本;规范科学是区域行政协议法治化之要;制度完备是区域行政协议法治化之基。不同维度、不同面向,区域行政协议法治化所面对的问题及其要求、路径是不同的。区域行政协议法治化应当根据区域行政协议不同维度、不同面向的问题所在,有针对性精细化地将区域行政协议纳入法治轨道,形成合力,共同为促进有效的区域协调发展新机制的建立健全,促进区域府际合作治理的发展提供制度力量。Regional Administrative Agreements(RAAs)are a kind of regular governance tool of regional intergovernmental cooperative governance,which in practice presents three dimensions:behavior,norm and system.The legalization of RAAs is a rational choice for the practice of regional intergovernmental cooperation governance.Among the three dimensions,the legality of behavior is the foundation of RAAs,normative science is the key to the legalization of RAAs and the complete system is the basis of the legalization of RAAs.The problems,requirements and paths faced by the legalization of RAAs are different in different dimensions and different aspects.According to the problems of different dimensions and different aspects of RAAs,the legalization of RAAs should be targeted and refined to bring RAAs into the track of the rule of law,form a joint force and work together to provide institutional strength for promoting the establishment and improvement of an effective new mechanism for coordinated regional development and promoting the development of regional intergovernmental cooperation and governance.
