绿色发展理念下天然林保护修复法律制度体系的构建

摘　　要：现行天然林保护制度存在规范层级低、天然林认定标准的不确定、重保护轻修复培育、天然林保护与利用的利益冲突未实现有效的法律调整等问题。天然林制度特有的“内核”及其与公益林的区别,决定了单独制定《天然林保护条例》的必要性。以《天然林保护条例》为制度体系的核心,以相关特别法、行政规章、地方立法为制度体系的重要组成部分,以技术规则为制度体系的重要支撑,是天然林保护修复制度体系的应然架构。建立保护与修复并重的规则体系,促进严格保护和科学经营的结合,创新天然林权益补偿机制,健全天然林保护修复的监督机制与法律责任,方可实现“更严密的法治、更严格的保护”的制度目标。The current natural forest protection system has many problems,such as low standard level,uncertainty of the identification standard of natural forest,emphasis on protection rather than restoration and cultivation,and failure to adjust the interest conflict between natural forest protection and utilization.The special"characteristic"of natural forest system and its different wtth the public welfare forest determine the necessity of formulating the Natural Forest Protection Ordinance separately.The framework of the natural forest protection and restoration system should take the Ordinance as the core of the system,relevant special laws,administrative rules and local legislation as important parts,and technical rules as the important support.Only by establishing a rule system that attaches equal importance to protection and restoration,combining the strict protection and scientific management,innovating the compensation mechanism for the rights of natural forests,and improving the supervision mechanism and legal responsibility for the protection and restoration of natural forests,can be achieved the institutional goal of"more strict rule of law and more strict protection".
