摘　　要：民法典是社会生活的百科全书,也是社会治理的大宪章。中国民法典作为21世纪世界最新的民法典,为中国社会治理现代化提供了规则书、路线图、工具箱,是中国民权保障、民生改善、民业兴旺、民心和顺、民风文明的压舱石。民法典坚持权利法定位,创设新型民事权利体系,推进权利本位型社会治理;坚持私法自治理念,构建多元民事主体制度,推进社会治理社会化;坚持契约治理理想,完善共商共治共赢机制,推进社会治理契约化;坚持守护社会公平正义,维护交换正义、分配正义、矫正正义,推进社会治理公正化;坚持私法公法相贯通,推动政府施政理念变革,促进政府治理迈向良政善治;坚持法治德治相融合,弘扬真善美,贬抑假恶丑,促进民风社风向上向善。Civil code is not only an encyclopedia of social life, but also a charter of social governance. As the latest civil code in the world in the 21 st century, China’s civil code provides rules, road map and toolbox for the modernization of China’s social governance. Civil code is the ballast stone of China’s civil rights protection, improvement of people’s livelihood, prosperity of folk industry and commerce, harmony of the people and civilization of folk customs. According to the orientation of rights-based law, civil code creates a new civil rights system, and promotes the social governance based on rights. In accordance with the idea of autonomy of private law, civil code builds a multiple civil subject system, and promotes the socialization of social governance. Based on the ideal of contractual governance, civil code improves the mechanism of joint discussion, governance and win-win, and promotes the contractualization of social governance. In order to uphold social fairness and justice, civil code safeguards exchange justice, distributive justice and corrective justice, and advances the fairness of social governance. In adherence to the integration of private law and public law, civil code pushes forward the reform of government administration conception and brings about good governance. Upholding the combination of rule of law and rule of virtue, civil law carries forward the true, the good and the beautiful, belittles the false, the evil and the ugly, and improves the social ethos.
