摘 要:在利益诉求不断权利化的背景下,因诉求内容的不同所生成的权利样态千差万别。这在各种不同类型的土地财产权层面,表现得尤为明显。作为土地市场上最为活跃的一项财产权——土地开发权,因其内生诉求的特殊性而有其独特的内容安排。明确土地开发权的内容,不仅是证成这一权利存在理据的内在诉求,更是揭示这一权利的实质内核、透视其在实证法上的规范样态以及展示其规范品格的外在保障。在中国语境下,尽管土地开发权的主体呈现出多元化的面相,法律性质上亦具有公私法二维属性,但这一权利的内容并没有因其主体、法律性质的复杂性和多面性而呈现出不确定性。从实践、规范和法理三个维度审视,中国语境下土地开发权的内容主要包括两方面:一是平面维度下的"土地用途能否变更";二是立体维度下的"土地开发强度能否变更"。土地开发权内容的二元化,意味着现代社会土地资源上的权利群与权力群之配置基点应从传统的以平面"用途"为中心,转向兼顾平面"用途"和立体"强度"的二维面相。In the context of the diversification of interest claims,the different forms of rights generated by the content of the appeal are different.This is particularly evident in the various types of land property rights.As the most active property right in the land market,the land development right has its own unique content arrangement because of the particularity of its endogenous appeal.To clarify the content of land development rights is not only the inherent appeal of evidence of this right,but also the external protection of its standard form and its normative character.From the three dimensions of practice,norms and jurisprudence,China’s land development rights mainly include two aspects:one is whether the land use can be changed under the plane dimension;the other is whether the land development intensity can be changed under the three-dimensional dimension.The dualization of the content of land development right means that the allocation bases of rights groups and power groups in modern social land resources should be oriented from the traditional plane"use"to the two-dimensional"use"and three-dimensional"strength".
