摘 要:就其本质而言,法学教育当是实践教育,几乎所有的法律条文都会应用于社会实践中,并在实践中贯穿法的意志与人的理性。然而结合法学院校的课程设置,传统观点功利性地将法律实践教育视同于职业实践教育,不断强化法律学习者的实践技能,却忽略了现代法律人文精神之提升。法律实践不单是法律职业共同体的高超技能,更重要的是包含了法律秩序下人的实践热情。换言之,成熟的法律实践应当是教育敢于为权利而斗争,为少数人而发声,为法治而奋斗的实践理性,并通过公益性诉讼等法治实践行为完善社会秩序,从而在实质意义上彰显实践教育下法律学习者的职业温度与人文关怀。In essence,legal education should be practical education.Nearly all legal provisions involve in social practice and the practice of them are the reflections of the will of the law and humanistic rationality.However,with the consideration of the current curriculums of law schools,traditional legal education adopts a utilitarian viewpoint to treat the practice in legal education as vocational education.This view may continuously strengthen the law practitioners’ practical skills,but ignore the potential of the improvement of humanistic spirit in modern law.In fact,legal practice is not only a collection of skills of the legal professional community,but more importantly,legal practice includes the practical enthusiasm of people under the legal order.In other words,mature legal practice should educate students’ and law practitioners’ rationality of practice.For example,the spirit to fight for human rights,to speak for societal vulnerable groups,to strive for the rule of law,and improve the social order through legal practice such as pro bono litigations.In this way,legal education can essentially foreground its professional warmth and humanistic care to law learners and law practitioners in practical education.
