摘　　要：民法典的頒饰是我國民法立法史上的里程碑事件,它標詰著我國民法從此進入以民法典為軸心的新階段。民法典統合了星散的民事單行法和民事司法解釋,使基本的、重要的民事法律規範定於一尊。在法典化、再法典化及解法典化交錯發生、交織並行的當代社會,民法典雖然已無法再稱作民法的百科全書,但它仍然可以被看作一個國家或地區民法基本理念、原則、概念、規則的集大成者。因此,即使在今天,民法典對於民事法律規範的統攝,在形式民法與實質民法兩方面,皆具有重要意義。The promulgation of the Civil Code is a milestone in the history of China's civil law legislation,and it marks the beginning of a new phase of China's civil law system with the Civil Code as the center.The Civil Code strings the scattered beads of single civil laws and judicial interpretations of civil laws,incorporating basic and important civil law norms under a single authority.In the modern society where codification,re-codification and de-codification alternate,a civil code,although cannot be called an encyclopedia of civil laws,may still be regarded as the compendium of the basic ideas,principles,concepts and rules of the civil laws of a country or a region.Therefore,even today,the unifcation of civil law norms in a civil code is still of great significance in both formal and substantive civil laws.The possible positive influence it may have on civil and commercial life and national development is even inestimable.Based on the development of the civil law since the reform and opening-up,China's civil laws,after entering the post-Civil Code era,would rapidly show two trends of development,namely,the Civil Code commentary and annotation or academice interpretation trend led by scholars,and a new wave of judicial interpretations led by the Supreme People's Court.Nevertheless,as far as the Civil Code itself is concermed,a comprchensive understanding of its formulating process and features,by virtue of both academic and judicial interpretations,would help enhancing the efect of legal interpretations.
