党政融合改革中行政主体资格的审视与认定

摘　　要：党政融合改革模式是本轮政府机构改革区别于以往历次机构改革的一大亮点,改革中出现了行政机关合并设立、党政机构合并设立、党政合署办公机制、机构转型与隶属关系调整等具体模式。对具体模式下的新机构主体资格进行理论分析,有助于厘清相应类型机构的行政主体资格,实现行政管理和行政执法的合法化运行。在法律规范与改革实践短期内仍然脱节的前提下,从坚持服务保障机构改革大局、坚持依法保障权利救济路径、坚持推动各方形成共识等三个主要因素综合考虑,对不同机构改革模式下新型机构的行政主体资格,提出了判断与认定标准,并对司法审查中出现的行政权名义混用、行政复议程序中复议机关确定等问题,有针对性地提出了对策建议。The model of the integration of the party and the government is one of the highlights of this round of government institution reform,which is different from the previous ones.In the reform,there appear some specific models such as the merger and establishment of administrative organs,the merger and establishment of the party and the government institutions,the establishment of the joint office mechanism of the party and the government,the transformation of institutions,and the adjustment of their affiliation.The theoretical analysis of the subject qualification of the newly-established institution under the specific mode is helpful to clarify the qualification of the corresponding institution as an administrative subject and to realize the legitimate operation of administrative management and administrative law enforcement.Within a certain period of time,the gap between the legal norms and the institutional reform will still exist.Taking this into consideration,we propose the criteria for determining the qualification of the newly-established institutions in this round of reform as a legitimate administrative subject by sticking to the following three principles:to ensure the success of institutional reform;to guarantee the access to rights relief;and to promote the parties involved to reach consensus.In addition,we offer some suggestions for dealing with such problems as the inaccurate citation of administrative power in legal review and the designation of the organ for handling the case of administrative review.
