医院融资租赁合同纠纷的诉讼情况分析——以法院判决为例展开

摘　　要：通过分析医院融资租赁合同纠纷的法院判决,了解医院融资租赁合同纠纷诉讼情况,为今后医院开展融资租赁业务提供参考。采用中国裁判文书网进行检索,选取截止时间为2019年12月31日的医院融资租赁合同纠纷的法院裁判文书,对判决文书中的原告被告情况、诉讼标的额、医院抗辩主张、医院胜诉败诉、融资租赁交易结构、二审判决结果等指标进行分析,得出近年医院融资租赁合同纠纷诉讼案件数量增长迅猛,医院对融资租赁业务的法律风险认识不足,防控措施有待加强。建议医院应充分评估融资租赁项目法律风险,全面加强对融资租赁业务的法律风险防控,注重日常证据的收集,切实加强租赁物的管理。Objective:According to analyzing court judgments on contract disputes of hospital financial leasing,to find out the litigation situation of contract disputes of hospital financial leasing,and to make the suggestion for hospitals to carry out financial leasing business in the future.Methods:Through searchingthe China Judgment Document Website,and collecting the court's judgments on the dispute over the hospital financial leasing contract with the deadline of December 31,2019,this paper analyzed the plaintiff and defendant,the amount of the object of action,the hospital's defense claims,the hospital's winning and losing,the financial leasing transaction structure,the second trial result,etc.Results:In recent years,the number of litigation cases of financial leasing contract disputes involving hospitals has grown rapidly.The hospitals have insufficient understanding of the legal risks of financial leasing business,so it needs to strengthen the prevention and control measures.Conclusion:The hospitals should fully evaluate the legal risk of financial leasing projects,comprehensively strengthen the legal risk prevention and control of financial leasing business,pay attention to the collection of daily evidence,and practically strengthen the management of leased property.
