摘　　要：水库库区的渔业资源常常置于公共领域,成为人们争夺的对象。为避免资源共有的损失,并获取相应的经济利益,激发了各方缔结集中性的产权合约。但是,保水渔业条件下的产出高估和产权完全界定的成本低估,加上跨区域治理高昂的协调成本,导致产权缔约往往失败。珊溪水库的产权缔约案例,既有其特殊性,也有一定的普遍性。简单地寄希望于市场化的承包出租和统一的国企经营,都难以有效解决跨行政区域库区渔业资源的高排他成本问题。无论什么比例的区域租金分配,也无法形成减少偷渔的选择性激励。为了合理解决生态保护、资源利用和利益平衡的治理难题,必须建立一种利益分享的产权制度和经济组织,使库区的绿水青山,成为百姓的金山银山,才能从根本上降低治理成本。The fishery resources in the reservoir area are often placed in the public domain and become the object of competition.In order to avoid the loss of common resources and obtain the corresponding economic benefits,all parties are encouraged to conclude a centralized property rights contract.However,under the condition of water conservation fishery,the overestimation of output and the cost underestimation of fully defined property rights,together with the high coordination cost of cross-regional governance,the property rights contracting often fails.The property right contracting case of Shanxi Reservoir has its particularity and universality.It is difficult to effectively solve the problem of high exclusive cost of fishery resources in the reservoir area across administrative regions by simply relying on market-oriented contracting and leasing and unified operation of state-owned enterprises.No matter what proportion of regional rent is allocated,there is no selective incentive to reduce illegal fishing.In order to reasonably deal with the problems of ecological protection,resource utilization and interest balance,it is necessary to establish a property right system and economic organization for benefit sharing,so as to make the clear water and green mountains in the reservoir area the treasure for the people and fundamentally reduce the governance cost.
