摘 要:对于不动产物权的变动,我国《物权法》确立了以登记要件主义为原则,登记对抗主义为例外的模式,造成了不同模式下各个效力的不同,引发了颇多争议。因此,对该项制度的设计需进一步修正,统一不动产物权变动的模式,明确规定不动产登记的推定力和公信力,深化不动产统一登记的改革,以此来维护各方主体的利益,促进财产的流转与经济的发展。As for the change of immovable property right,the property law of our country has established the mode of taking the registration element doctrine as the principle and the registration antagonism as the exception,which has caused the difference of each effect under different modes and caused many disputes.Therefore,the design of this system needs to be further revised to unify the mode of real estate right change,clearly stipulate the presumption and credibility of real estate registration,deepen the reform of real estate unified registration,so as to safeguard the interests of all parties and promote the circulation of property and economic development.
